Eligibility is limited to specific Native entities. Eligible applicants include federally recognized Native American tribal governments and eligible Native American tribal organizations. A tribe is generally eligible if it is an Indian tribe, band, group, or nation (including Alaska Indians, Aleuts, and Eskimos) or an Alaska Native village that qualifies as an eligible recipient under Title I of the Indian Self-Determination and Education Assistance Act, or that previously qualified under the State and Local Fiscal Assistance Act of 1972. Determinations under the Indian Self-Determination and Education Assistance Act are made by the Bureau of Indian Affairs, while determinations under the State and Local Fiscal Assistance Act were made by the Department of Treasury's Office of Revenue Sharing. The NOFO references the Federal Register listing of Indian entities recognized by and eligible to receive services from the Bureau of Indian Affairs as a key source for confirmation of eligible entities.

Tribal organizations may also apply, but only under specific conditions. An eligible tribal organization under Title I of the Indian Self-Determination and Education Assistance Act can apply on behalf of one or more eligible tribes or Alaska Native villages, provided the affected tribe(s) authorize the organization to do so through concurring resolutions. Those resolutions must be included with the application, since they serve as formal documentation that the tribal organization is acting with the tribe's approval. Eligibility for tribal organizations is determined by the Bureau of Indian Affairs or the Indian Health Service, depending on the organization and context. The NOFO also makes clear that individuals, foreign entities, and sole proprietorships are not eligible to apply for or receive awards under this announcement.
